Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 385, 387, 435, 307/34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the petitioner resorted to fire on the gate of the informant, put the gate of the informant on fire and demanded Rs. 2,00,000/-. It is submitted by the learned counsel for the petitioner that petitioner did not demand extortion money. Earlier three cases have been lodged by the informant, in which he has been granted bail. Admittedly, neither any injury was caused to anyone nor any damage was done.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.6084 of 2016 (2) dt.08-02-2016 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with S. Kamal P.S. Case No. 315 of o2014, pending in the court of learned Sri Deo Priya, J.M., Ist Class, Begusarai.
With this observation this application is disposed of.
