Heard the parties.

The petitioner was allowed bail on 05.09.2019 in Cr. Misc. No. 54468 of 2019 with condition that the petitioner would be released if the trial is not concluded within six months from the date of framing of charge.

Learned counsel for the petitioner submits that the aforesaid condition was imposed for the reason of criminal antecedent of the petitioner. However, in the circumstance arising out of COVID-19 effect, the trial is not likely to be concluded in near future. Hence prayer is to modify the

Patna High Court CR. MISC. No.11662 of 2020(2) dt.07-07-2020 2/2 aforesaid condition.

Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Begusarai Muffasil P.S. Case No. 61 of 2018 with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Accordingly, this modification application stands disposed of.
