JUSTICE SANJAY PRIYA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in GRP/DBG/SMI P.S. Case No. 83 of 2016 instituted for the offence under Section 370 of the Indian Penal Code and Section 16 of the Bonded Labour System (Abolition) Act.

It is alleged in the written report that accused persons were taking total ten children to Pune for human trafficking through train. On confidential information, the police arrived there and released total ten children from the custody of accused persons and arrested four persons including the petitioner.

It has been submitted on behalf of the petitioner that it is mentioned in the impugned order that

Patna High Court Cr.Misc. No.3008 of 2017 (2) dt.06-02-2017 2/2 children in paras 32, 33, 34, 36, 37, 39 of the case diary have stated that the children were going to Pune for doing labour work. The petitioner is in custody since 19.10.2016 and statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate(Rail), Samastipur in connection with GRP/DBG/SMI P.S. Case No. 83 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
