01-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant by Rahul Pandey and the petitioners being family members of Rahul Pandey facilitated the abduction of the daughter of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are resident of Jharkhand and thrust of the accusation is against son of petitioner no. 1. The victim girl has

Patna High Court Cr.Misc. No.4319 of 2016 (2) dt.01-02-2016 2/2 sworn affidavit and claimed herself of 20 years of age and has performed marriage with Rahul Pandey. The petitioners have only been roped in because they are parents, brother and unmarried sisters of Rahul Pandey. Statement has been made in paragraph-3 of the petition that the petitioners have got no criminal antecedent. Considering the fact that specific accusation of abduction of daughter of the informant has been levelled against Rahul Pandey, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada (Town) P.S. Case No. 661 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
