JUSTICE RAKESH KUMAR ORAL ORDER 19-04-2017 Heard Sri Damodar Prasad Tiwary, learned counsel, assisted by Sri Prem Ranjan Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the second attempt for grant of bail on behalf of the petitioner. Earlier the prayer for bail of the petitioner was rejected on 05.12.2016 vide Cr.Misc.No.41707 of 2016. In this case, there was recovery of 500 gms of Ganja besides 20 Puriyas of Ganja.

It was argued by learned counsel for the petitioner that recovered ganja is much lesser than the smaller quantity and the petitioner is in custody since 07.08.2016. Considering the period of custody as well as lesser quantity of recovery of Ganja, let the petitioner, namely, Ram

No.15296 of 2017 (3) dt.19-04-2017 2/2 Kishun Chauhan @ Ram Kishun be released on bail on furnishing bail bond of Rs.10, 000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Nawada in connection with Nardiganj P.S. Case No.112 of 2016 (Special Case no.02 of 2016).
