The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 105 litres of semi processed material for manufacture of liquor and 12 litres of country made liquor was recovered from the agricultural land belonging to the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession or land. He is in custody since 2.12.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Minapur P.S. Case no. 439 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no.I, Muzaffarpur. (Partha Sarthy, J) Bibhash/- U
