JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 247 of 2019, registered for the offence punishable under Section 379 of the Indian Penal Code.

Allegation is of theft of motorcycle and petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that he was arrested in connection with other case and he has been remanded in this case and there is no recovery of stolen motorcycle from his possession, rather another motorcycle was recovered and he is in custody since 14.10.2019 and charge sheet has already been submitted in this case. Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.8237 of 2020(2) dt.25-02-2020 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Bhagwanpur P.S. Case No. 247 of 2019.
