The petitioner is accused in connection with Malsalami P.S. Case No. 212 of 2015, registered under Section 302 of the Indian Penal Code.
The allegation of informant Manish Kumar Goswami is that the marriage of his sister, namely, Manisha Goswami was performed with this petitioner in the year 2012 and there is two children born out of their wedlock. The sister of the informant Manisha Goswami was a teacher in a school and petitioner used to ask her leave the job, but she was not ready to leave the job of teacher. On 12.09.2015 informant along with his mother and father went to the house of his sister and on the next
Patna High Court Cr.Misc. No.2555 of 2016 (5) dt.29-03-2016 2/2 morning his sister was dashed from the roof and horridly she was rushed to the Laxmi Shree Nursing Home at Gulzarbagh for treatment by the petitioner.
Learned counsel for the petitioner submits that, in fact, the deceased Manisha Goswami, sister of the informant fell down from the roof and sustained grievous injury, while she was rushed to the hospital by this petitioner for treatment, but due to some ulterior motive informant implicated the petitioner in this case. Moreover, there is no allegation of demand of dowry in the F.I.R. The petitioner is in custody since 14.09.2015. On the other hand, learned counsel appearing on behalf of the informant submits that deceased had stated about demand of dowry by the petitioner and his family members. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.K.
