The petitioner seeks regular bail in connection with Minapur P.S. Case No. 495 of 2021 lodged under Sections 272, 273 and 34 of the Indian Penal Code and 30 (a) of Bihar Prohibition & Excise (Amendment) Act 2016.

Learned counsel for the petitioner submits that petitioner has committed no offence and nothing was recovered from conscious possession of the petitioner. He admits that total 169.92 liters foreign liquor was alleged to be recovered from the side of road of village but not from the petitioner's possession. Learned counsel for the petitioner submits that charge sheet has already been filed in this case and petitioner is in custody since

Learned APP for the State opposes the prayer for bail. In the present facts and circumstances that the petitioner is in custody since 25.12.2021, charge sheet has already been filed and having clean antecedent, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Minapur P.S. Case No. 495 of 2021.
