JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, the name of petitioner came in this case and subsequently, petitioner was arrested and confessed his guilt. Similarly, one Sunny Kumar was also arrested in connection with Siwan (M) P.S. Case No. 138 of 2015 and the aforesaid co-accused Sunny Kumar named the petitioner in his confessional statement. So far as recovery of snatched motorcycle is concerned, it is submitted that the same has not been recovered from conscious possession of the petitioner.

No doubt, petitioner carries criminal antecedent but in the present case, it appears that except confessional statement,

Patna High Court Cr.Misc. No.2284 of 2016 (2) dt.28-01-2016 2/2 there is nothing against the petitioner.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Phulwariya P.S. Case No. 53 of 2015 to the satisfaction of learned Judicial Magistrate-Ist Class, Gopalganj. (Hemant Kumar Srivastava, J) A.K.V./- U T
