The petitioner has sought release of the goods seized by the police while investigating Civil Lines Police Station Case No.105 of 2009.

As per the petitioner, in a final report submitted by the police, no case was made out, and that such final report has since been accepted by the Court of competent Magistrate. The petitioner has now sought release of the articles seized in the said F.I.R. in which an order of discharge has been passed against the petitioner.

Admittedly, the petitioner has a remedy to move an appropriate application before the Magistrate who has accepted the cancellation report. As and when, the petitioner files such an application, I have no doubt that the concerned Magistrate shall
