Petitioner is not named and it appears from perusal of the impugned order that the name of petitioner came in confessional statement of co-accused, Bhikhari Yadav. Although it is obvious from the impugned order that the original case diary was not before the court below at the time of passing impugned order but submission on behalf of petitioner is that except confessional statement as well as some criminal antecedent, there is nothing against the petitioner who is languishing in jail custody since 08-09-2015.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.2477 of 2016 (2) dt.29-01-2016 2/2 thousand) with two sureties of the like amount each in connection with Bairgania P.S. Case No. 48 of 2011 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
