The petitioner seeks bail in Banka P.S. Case No. 104 of 2013 instituted for the offence under Sections364/201/34 of the Indian Penal Code. It is alleged in the written report that on the date of occurrence, the husband of the informant received telephonic call that this petitioner along with other accused namedly, Shahadat Ansari and Rahman Mian are waiting for arrival of husband of the informant. Thereafter, her husband went there but did not return.
It has been submitted on behalf of the petitioner that mere suspicion has been raised against him. The one
Patna High Court Cr.Misc. No.14718 of 2017 (2) dt.26-04-2017 2/2 co-accused who is alleged to have been named in the FIR has been granted bail by a coordinate bench of this court vide order dated 28-02-2017 passed in Cr. Misc. No. 9163 of 2017 and two other persons have been granted bail by a coordinate bench of this court vide order dated 14-03-2014 passed in Cr. Misc. No. 53312 of 2013. .
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Banka P.S. Case No. 104 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Banka subject to condition that both the bailors should be close relatives of the petitioner.
