The petitioner apprehends his arrest in connection with Jokihat P.S. Case No. 84 of 2015 for offence punishable under Sections 353 and 307/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.
Taking note of the circumstances resulting in the police case in which there has been a cross fire in between the police and the accused and that in the process while two were apprehended, the present petitioner has escaped as informed by the apprehended accused, I am not persuaded to grant indulgence to the prayer made for anticipatory bail and this application is thus disposed of with direction to the petitioner to surrender and pray for regular bail which prayer would be considered by the court below on its own merit and be disposed of without being prejudiced by the order passed in the present proceeding.
