This is a petition for grant of regular bail for offences under Sections 363, 364A and 34 of the Indian Penal Code.
The petitioner is named in the first information report with allegation that he kidnapped the minor daughter o the informant. The victim-girl in her statement under Section 164 of the Criminal Procedure Code stated that the petitioner had committed rape against her. She has named the petitioner as Rabi whereas before police she named the petitioner as Rabindra. The petitioner has not disputed that his name is not Rabi.
The learned counsel for the petitioner submits that Rabindra and Rabi are two different persons. He, further, submits that at the time of Panchayati the victim had stated that nothing happened with her and the
Patna High Court Cr.Misc. No.15864 of 2017 (3) dt.09-05-2017 2/2 victim was found in her own house.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.
The prayer for bail is refused.
