The petitioner is in custody in connection with Bathanaha P.S. Case No.23 of 2015 for the offences punishable under Sections 399, 402 and 115 of the Indian Penal Code. The F.I.R. present at Annexure-1 would suggest that the petitioner along with other named accused were planning dacoity and whereas the other accused were apprehended by the police, this petitioner is stated to have escaped and his name has been given by one of the co-accused.

Mr. V.R.P. Singh learned counsel for the petitioner has submitted that whereas the others have been granted bail by the court below itself, the prayer of this petitioner has been rejected inter alia in the backdrop of the antecedents that he carries even

Having heard learned counsel for the parties and considering the nature of allegation in the backdrop of the antecedent that the petitioner carries, the prayer made by the petitioner is rejected presently.

The bail application is dismissed.
