1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Sikarpur P.S. Case no.702 of 2023 registered under sections 302 and 201 of the Indian Penal Code.
3. As per the prosecution case, the informant states that he received information about the death of his daughter. On reaching his daughter's place he found her dead body in the agricultural land. The informant states that he suspects that his son-in-law ie the petitioner herein has a hand in her murder.
4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the deceased. It was a case of suicide by hanging. On learning the
Patna High Court CR. MISC. No.13834 of 2024(3) dt.24-04-2024 2/2 true fact, the informant has filed a joint petition stating that he is no longer interested in pursuing the case. The petitioner is in custody since 4.9.2023 and undertakes to cooperate in the trial.
5. Heard learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner being the husband of the deceased together with the material that has transpired in course of investigation, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
