The accusation against the petitioner is that he having entered into the house of the informant tried to outrage her modesty by removing her cloths but submission on behalf of the petitioner is that the informant is a lady of questionable character and as a matter of fact prior to institution of the present case, the villagers had filed a petition before the Sarpanch of the village against bad character of the informant and that is the reason of false implication of the petitioner in the alleged crime because it was the petitioner who had taken active part in getting the filing of petition against the informant.
Considering the facts and circumstances of the
Patna High Court Cr.Misc. No.1204 of 2016 (2) dt.13-01-2016 2/2 case as well as submissions of the parties, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Bihariganj P.S.Case No. 187 of 2015.
