This application is for grant of anticipatory bail in connection with Kishanganj P.S.Case No.433 of 2016 for the offence under Sections 419, 420, 467, 468, 471, 120 and 34 of the Indian Penal Code.
It is submitted on behalf of the petitioners that the allegation against the petitioners is that on the basis of forged certificate, they have taken employment but the aforesaid forged certificate has been verified by the D.E.S. and other Officers and only thereafter, appointment letters were issued to the petitioners. It is further submitted that in a similar case, one
co-accused has been granted anticipatory bail by this Hon'ble Court, vide order dated 22.12.2016 passed in Cr. Misc. No.54878 of 2016.
Heard learned counsel appearing on behalf of the Vigilance. It has not been controverted by the learned counsel for the vigilance that the another co-accused having similar allegation has been granted anticipatory bail. Having heard both sides. In view of the fact that co-accused having similar allegation has already been granted anticipatory bail by this Hon'ble Court, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S.Case No.433 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, with condtion that they will co-operate in the investigation as well as during the trial of the case.
Accordingly, this application is allowed.
