It is evident from the counter affidavit filed on behalf of respondent-State authorities that the process of grant of promotion from lower subordinate education service to subordinate education service is still going on. Some decisions had been taken earlier and promotion to 147 persons has already been granted. It is said that the promotion had been granted only till Sr. No. 527 of the seniority / gradation list, whereas the petitioners are at serial no. 574, 583 and 585.

Patna High Court CWJC No.1403 of 2016 dt.18-04-2016 2/2 Learned counsel for the petitioners submits that there are almost 22 people with Sahitya Alankar degree are occupying the post as well as there are certain posts which are still being reserved for SC/ST for promotion.

All these matters will be looked into when next round of deliberation or exercise is being taken for grant of promotion. Writ application is disposed off with observation that claim of the petitioner would be surely considered, if they come within the zone of consideration, depending upon the vacancies which has or will crop up in this regard.
