JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Muzaffarpur Rail P.S. Case No. 114/2016, registered under Sections 379 and 411 of the Indian Penal Code. The accusation is that on 28.12.2016 when the informant came at the enquiry counter of Railway Station, Muzaffarpur, at that time, some unknown thief committed theft of his purse, containing Adhaar Card, PAN Card, ATM Card, cash Rs. 300/- and also Adhaar Card and Identity Card of his wife and brother. The informant again came on 29.12.2016 at the railway station in search of the thief, then he saw two persons, who were present near him on 28.12.2016. Both were apprehended with the

Patna High Court Cr.Misc. No.18567 of 2017 (2) dt.04-05-2017 help of passengers and from their possession some stolen documents recovered. They disclosed their name Manish Kumar (petitioner) and Vikash Kumar.

Submission is that the petitioner and one Vikash Kumar were apprehended by the informant mere on suspicion. Coaccused Vikash Kumar has already been allowed bail vide order dated 27.03.2017 passed in Cr. Misc. No. 13998/2017. The petitioner is in custody since 29.12.2016 and the charge-sheet has already been submitted against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner, Manish Kumar, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (Railway), Sonepur at Saran in connection with Muzaffarpur Rail P.S. Case No. 114/2016.
