Perused the order dated 02.07.2015 passed by learned Sub Judge V, Begusarai in Title Eviction Suit No.319 of 2008 whereby the Court below has only passed the consequential order under Section 15 of the B.B.C. Act and struck off the defence of the petitioner for non-compliance of the order passed by the Court under Section 15 of the B.B.C. Act. Therefore, this order is consequential order.
Admittedly, as has been submitted by the learned counsel for the petitioner, the order whereby the petitioner was directed to deposit the arrears and current rent was under challenge before the High Court in CWJC No.6545 of 2013 which has been dismissed for default.
Now, therefore, I find no reason to interfere with the
Patna High Court CWJC No.1827 of 2016 (3) dt.18-07-2016 impugned order passed by the Court below and accordingly, this writ application is dismissed.
