ANJANA MISHRA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147/ 148/149/323/324/307/379 of the Indian Penal Code. Learned counsel for the petitioners submits that so far as petitioners No. 1 and 3 are concerned, there is general and omnibus allegation against them. With regard to petitioner No. 2, he submits that the allegation of attacking the informant Gena Ram is concerned, the injury report indicates that most of the injuries are mere laceration whereas the one which is said to be "on the left shoulder and stated to be a tenderness over the left shoulder is a grievous injury and has been described to have been caused by hard and blunt substance." He, however, submits that

Patna High Court Cr.Misc. No.3554 of 2016 (2) dt.18-02-2016 P2/2 such an allegation is wholly unfounded and petitioner No. 2 was not the only one who has inflicted blow and the said injury cannot be purely attributed on his shoulder.

Considering the aforementioned submission and the nature of occurrence and also because the petitioners have no criminal antecedent, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya Banjariya P.S. Case No. 781 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
