The Petitioner seeks bail in Majhaulia P.S. Case No. 265 of 2016 instituted for the offence under Section(s) 47(a) of the Bihar Excise Act.

It has been submitted that petitioner is aged about 68 years. The seizure list does not bear the signature of the petitioner.

It is alleged in the written report that six litres of illicit liquor and some articles for manufacturing the liquor have been recovered from the possession of this petitioner. The seizure list annexed as Annexure-2 does

It has further been submitted that another coaccused Langad Manjhi with similar allegation has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 599 of 2017 on 11.01.2017.

The petitioner is in custody since 13.12.2016. It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 265 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
