The petitioner apprehends his arrest in connection with Konch P.S. Case No. 175 of 2019 registered for the offences punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is that the petitioner along with the other co-accused persons assaulted on the head of the informant by means of lathi and iron rod causing simple injury to him.

Learned counsel for the petitioner submits that the occurrence took place on 18.05.2019 whereas the FIR has been lodged on 01.06.2019 and there is no cause of delay mentioned in the FIR. He further submits that the injury found on the informant is simple in nature and the petitioner has no criminal antecedent.

No.9346 of 2020(2) dt.29-02-2020 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release them on bail on furnishing bail bonds of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Konch P.S. Case No. 175 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
