Petitioner is accused in connection with Complaint Case No. C2-439 of 2016 registered under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. It is submitted that petitioner is quite innocent and is in custody since 24.12.2016, having no criminal antecedent.
