The petitioner seeks bail in connection with Kothi P.S Case No. 14 of 2016 registered for the offence punishable under Section 386 of the Indian Penal Code and Section 17 C.L.A. Act.
Allegedly, ransom of Rs. 5 lacs was demanded from the informant otherwise to burn the machines and other articles of construction company and further the miscreants snatched the key of J.C.B. machines. F.I.R is against unknown and from impugned order it reveals that the petitioner has confessed his guilt and accordingly he has been remanded.
Submission is of false implication and that besides
Patna High Court Cr.Misc. No.7421 of 2017 (2) dt.20-03-2017 2/2 the alleged confessional statement made before the police there is no other material against the petitioner which is evident from impugned order itself. The petitioner has got criminal antecedent, but he has been falsely implicated in those cases by the police, in some cases he has been granted bail under Section 167 (2) of Cr.P.C. and, as such, he deserves sympathetic consideration. Learned A.P.P. fairly submits that the petitioner has confessed his guilt.
In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M., Sherghati (Gaya), in connection with Kothi P.S. Case No. 14 of 2016, (G.R. No. 603 of 2016) subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
