The petitioner seeks regular bail in connection with Jadopur P.S. Case No. 39 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The allegation is regarding recovery of 48 litres of illicit liquor from a place situated besides the hut of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is accused in one other case but the petitioner has been made an accused in the said case only after filing of the present case and he is on bail in the said case. The petitioner is stated to be languishing in

Patna High Court CR. MISC. No.16125 of 2019(2) dt.26-03-2019 2/2 custody since 16.01.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge (Excise), Gopalganj in connection with Jadopur P.S. Case No. 39 of 2018.
