The petitioners apprehend their arrest in connection with Suryapura P.S. Case No.91 of 2015 for the offences punishable under sections 341, 323, 324, 504, 379, and 307/34 of the Indian Penal Code.
Considering the specific allegation against the petitioner nos.1 and 2, namely, Sanoj Kumar Singh @ Sanoj Kumar and Manoj Kumar, @ Manoj Kr. Singh of assaulting the brother of the informant the prayer for anticipatory bail of petitioner nos.1 and 2 is rejected. They should surrender and pray for regular bail which should be considered and disposed of by the court below on its own merit without being prejudiced by
Patna High Court Cr.Misc. No.5113 of 2016 (2) dt.29-03-2016 the order passed in this proceeding.
In so far as the petitioner no.3 is concerned, considering the nature of allegation let the petitioner no.3, namely, Rajni Kuwar @ Ranjani Kuwar in the event of her arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Kumar, Judicial Magistrate 1st Class, Bikramganj (Rohtas) and/or the court concerned in connection with Suryapura P.S. Case No.91 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
This application is allowed in part.
