JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-07-2020 This case has been heard through videoconferencing. Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 376 and 419/34 of the Indian Penal Code.
Petitioner is said to have induced the informant/ opposite party no.2 telling her that he is a mechanical engineer in Mumbai and he will marry with her. On the said assurance, he took away her to a hotel at Sitamarhi and made physical relationship with her and when she requested to get marry with

Thereafter, she returned to her home and told her parents about the occurrence and they along with her went to the houses of the petitioner and requested the family members of the petitioner to get marry the petitioner with her but they refused and expelled her and her parents from their house assaulting them.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. As a matter of fact, after intervention of the well wishers of both the families marriage has been performed and they are living peacefully as husband and wife. Petitioner has no criminal antecedent. Learned counsel for the informant does not dispute the aforesaid fact.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in connection with Sursand
