ANJANA MISHRA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner Ranju Devi apprehends her arrest in connection with a case registered for the offences punishable under Sections 341/323/302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though there was an altercation in which the petitioner had also participated, the allegation against her is that she had attacked the deceased with a brick which hit the chest of the deceased. However, no such injury has been found on the person of the deceased as stated in the post-mortem report. He further submits that only one injury which has been found on the person of the deceased was on the

Patna High Court Cr.Misc. No.3574 of 2016 (3) dt.18-02-2016 P2/2 thigh. He has also opined that on account of hemorrhage of intra cranial cavity the deceased succumbed to his injuries. Considering the aforementioned facts and circumstances and the materials available in the case diary and also that the petitioner has no criminal antecedent, let the petitioner Ranju Devi, in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned 5th Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatia (sirisiya O.P.) P.S. Case No. 243 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
