JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is surprising enough that only 5 kg Sattu, 1 Kg Oal and other articles are said to have been recovered from conscious possession of the petitioner but even then the present case has been lodged and petitioner was remanded in the present case. It is also shocking to see that petitioner is in jail custody since 4.11.2015 but not only the prayer for bail of the petitioner was rejected by the concerned Railway Magistrate but also by the learned Additional Sessions Judge, Bhojpur at Ara without applying their judicial mind.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.502 of 2016 (2) dt.07-01-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Bhojpur at Ara in connection with Ara Rail P.S.Case No. 55 of 2015.
