JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 386, 387 read with Section 34 of the Indian Penal Code and under Sections 25(1-b)A, 26, 37, 35 of the Arms Act.

It is alleged that the petitioner took beer from the beverage shop of the informant on the pistol point subsequently the informant intimated the police. Thereafter, the accused persons again came and demanded extortion of Rs. 20 lacs but they have been apprehended. From the possession of accused Badal Singh one country made pistol and cartridge were recovered. It is submitted by the learned counsel for the petitioner that on the basis of suspicion the accusation has been levelled

Patna High Court Cr.Misc. No.3168 of 2016 (2) dt.20-01-2016 2/2 against the petitioner and the recovery has been made from the coaccused Badal Singh. The aforesaid facts constitute ground for consideration of prayer for regular bail let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Laxmipur (Gidhor) P.S. Case No. 198 of 2015 pending in the court of learned Subdivisional Judicial Magistrate, Jamui. Accordingly, this application is disposed of. (Dinesh Kumar Singh, J.) KKSINHA/N.H.
