JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation against the petitioner that he opened fire. Earlier his prayer for bail was rejected by this Court vide order dated 29.09.2016 passed in Cr. Misc. No. 40439/2016. Again, I am not inclined to release the petitioner on bail on the grounds mentioned in previous aforesaid order and accordingly, the prayer for bail of the petitioner in connection with S.Tr. No. 512/2016, arising out of Chandi P.S. Case No. 148/2016,

Patna High Court Cr.Misc. No.4576 of 2017 (3) dt.29-03-2017 2/2 pending in the court of the learned Additional Sessions Judge I, Nalanda stands rejected.

However, the learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of a copy of this order.

It is made clear that if the trial of the petitioner is not concluded within the above stated period due to laches of the prosecution, the petitioner may renew his prayer for bail before the learned trial court itself.
