JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 9.9.2015 in a case registered under Sections 363, 366A/34 of the Indian Penal Code on the accusation that he kidnapped a minor girl. The statement of the victim has been recorded under Section 164 of the Cr.P.C. in which she supported the story of kidnapping and stated that she was forcibly taken to Delhi where she was kept in a room for near about three months but she also admitted that petitioner brought her and surrendered before the court.

The contention on behalf of the petitioner is that the age of victim has been assessed by Medical Board between 16-17

Patna High Court Cr.Misc. No.660 of 2016 (2) dt.08-01-2016 2/2 years and as a matter of fact there was love affair between the petitioner and the victim but the victim made statement under Section 164 of the Cr.P.C. under influence of her family members. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Barauni P.S. Case No.196 of 2015.
