The petitioner seeks bail in connection with Mahua P.S. Case No. 371 of 2019, registered under Sections 25 (a)(1-b), 26 and 35 of the Arms Act.

The accusation is that in course of checking of the vehicle, three persons were seen boarding on Apache motorcycle, which was without number plate. The Police personnel gave signal to stop the vehicle, then two persons succeeded to escape, but the person who was driving the motorcycle was apprehended, who disclosed his name Rajeev Kumar Yadav. On search, one loaded country made pistol recovered from his possession. The apprehended person disclosed the name of Badri Singh (petitioner) and one friend

Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and his name surfaced in the confessional statement of Rajeev Kumar Yadav. Further submission is that, in fact, petitioner is accused in five other cases, as detailed in paragraph No.3, due to that reasons, the Police got implicated the petitioner showing his name in the confessional statement of Rajeev Kumar Yadav. The petitioner is in custody since 04.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S.
