====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner apprehends his arrest in connection with Alamganj P.S. Case No.726 of 2018registered under Sections 376 and 377 of the Indian Penal Code. The accusation is that the petitioner on several occasions developed physical relation with the informant, who is widow lady, on the pretext of performing the marriage but, later on, the petitioner refused to perform the marriage with the informant.

Learned counsel for the petitioner submits that, in fact, the informant is widow lady and she has male issue aged

Only to put undue pressure upon the petitioner to perform the marriage, the informant has lodged the present case, while the petitioner is already married. It has further been submitted that, the mother of the informant, in her statement, as detailed in paragraph-4 of the case diary, has stated that the informant is of quarrelsome lady and the informant used to give threatening to her, if she will depose in her case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Alamganj P.S. Case No.726 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
