The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 323, 337, 338, 504, 435, 427, 307, 332, 353, 283, 188, 379 of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Public Property Act.

As per allegation in the FIR, the petitioner along with other co-accused persons have created hindrance by pelting stones to the police party in discharging the official duty and also damage the wind screen of the various vehicles. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is alleged to be only member of mob due to which he has falsely been implicated in this case. There is no specific

It is further submitted that other co-accused namely, Sindheshwar Chaupal has already been granted bail by this court vide order dated 25.4.2023 passed in Cr. Misc. No. 12874 of 2023 hence, the case of this petitioner stands on similar footing of that of the co-accused. Moreover, he is languishing in judicial custody since 29.9.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Laukahi P.S. Case No. 257 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-I, Jhanjharpur, Dist- Madhubani.
