2. The petitioner apprehends his arrest in a complaint case punishable for the offence under Sections 323, 379, 406, 504, 506 of the Indian Penal Code.

It is alleged that this petitioner, who is own Mausa of complainant, took total Rs. 1,70,000/- from the complainant in lieu of some personal work and assured to return money, but after expiry of specified time, he did not return and when complainant demanded his money, this petitioner refused to return money and also abused him.

4. Learned counsel for the petitioner submits that

No.11184 of 2026(5) dt.23-07-2026 2/2 from bare perusal of complaint petition, it is apparent that alleged payment was made between June 2015 to July 2018, but the complaint has been lodged in the year 2023. Petitioner is own Mausa of complainant and on account of property dispute, this false and concocted case has been lodged. Moreover, the case is purely civil in nature, for which, complainant has got some alternative remedy. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Complaint Case No. 9266 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
