Petitioner is not named in the first information report but in course of investigation, some witnesses claimed to have identified the petitioner fleeing from the place of occurrence and later on, one coaccused Chandan Kumar was arrested and confessed his guilt disclosing the name of the petitioner and his associates and furthermore, on the basis of the confessional statement of co-accused Chandan Kumar, looted motorcycle was recovered from the possession of Mahesh Baitha.

Moreover, having similar allegation, co-accused Raju Kumar has already been granted privilege of bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
