Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 363, 366, 366A and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner, being married sister of Ajay Kumar, has been falsely implicated in the instant case by the informant who alleges that this petitioner along with his brother came to his house and asked the victim (minor daughter of the informant aged about 17 years) to accompany them to the market, on which the informant objected, but still, the victim went with them with an assurance that they will return within half an hour, but when the victim did not return till 6 p.m., then the informant inquired and came to know that the accused persons, including

The learned counsel submits that the victim and Ajay Kumar were in love and they eloped. It is also submitted that the victim is not a minor, rather is a major, and thus her marriage with Ajay was notarised. It is also submitted that since the petitioner is sister of Ajay, as such she has been implicated in order to coerce Ajay into submission.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Tajpur P.S. Case No. 542 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
