JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-02-2020 This is an application for grant of anticipatory bail in connection with Amarpur P.S. Case No. 398 of 2019, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

After some arguments, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to the petitioner to surrender before the learned court below and seek regular bail.

Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner to surrender before the learned court below and in case, he surrenders within four weeks from today, the learned court below is directed to consider and dispose of the prayer of the petitioner for grant of bail in connection with Amarpur P.S. Case No. 398 of 2019

Patna High Court CR. MISC. No.8845 of 2020(2) dt.29-02-2020 2/2 pending before the Additional Sessions Judge-II, Banka on the very same day especially considering the fact that meagre quantity of illicit liquor has been recovered and the petitioner was not present in the house when the alleged illicit liquor is stated to have been recovered.
