Petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No.312 of 2018 for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
The allegation against the petitioner is that he along with other persons pressurized the Opposite Party No.2 to sign the sale deed prepared in the name of Sunil Sah and Chandan Kumar Singh as vendee and the Opposite Party No.2 was taken in Lichhavi Hotel at Hajipur wherein the accused persons upon threat of killing him compelled to sign on already prepared sale deed of land belonging to Opposite Party pertaining to Khata
Patna High Court CR. MISC. No.13669 of 2019(4) dt.08-07-2019 2/3 No.129, Khasra No.1088 measuring 93 decimal about 21 Katha) situated in Village-Kuwari Khurd, Hajipur, Vaishali. Learned counsel for the petitioner submits that petitioner is not concerned with the land in question which has allegedly been purchased by virtue of sale deed by pressurizing the vendor-Opposite Party No.2 and he further submits that petitioner is only a deed writer and has been impleaded in this case on the basis of allegation that the sale deed was written by the deed writer, i.e., petitioner.
Learned counsel for the informant submits that the petitioner along with others have got the sale deed executed by putting pressure upon Opposite party No.2 and 21 Kathas of land has been transferred in the name of other co-accused based upon the sale deed drafted and written by the petitioner, who is deed writer.
After having heard learned counsel for the parties and taking into consideration the fact that the petitioner is only deed writer, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by the petitioner, he shall be released on anticipatory bail by the Court below upon furnishing
Patna High Court CR. MISC. No.13669 of 2019(4) dt.08-07-2019 3/3 bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
