JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he and others assaulted injured Birendra Kumar and others. The injured Birendra Kumar sustained grievous injury and having similar allegation, co-accused Satya Narayan Sah has already been granted privilege of bail by this Court vide order dated 20.8.2015 passed in Cr. Misc. No.34293 of 2015 and at the time of consideration of bail of the aforesaid co-accused it was brought to the notice of this Court that injured Birendra Kumar specifically stated that it were co-accused Raj Kumar Sah and Shiv Kumar Sah who assaulted him with lathi.
