2. The petitioners are in custody since 23.10.2016 in connection with S. T. No. 15 of 2017 arising out of Rail P.S. DBG (Jaynagar) Case No. 86 of 2016 for the offences alleged under Sections 47 and 57 of the Bihar Excise(Amendment) Act, 2016 and Sections 137 and 147 of the Railway Act.

3. It is submitted that the petitioners have been falsely implicated in connection with the alleged recovery of 57 and 44 bottles of Nepali country made liquor containing 300 ML in each bottle. Recovery of the offending goods from the possession of the petitioners is denied. The petitioners claim clean antecedents.

4. Be that as it may, having regard to the entirety of the facts and circumstances of the case as well as the period of custody since 23.10.2016 already suffered, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned ASJ-II, Samastipur in connection with S. T.
