Learned counsel for the petitioner, after some argument, seeks permission to withdraw the writ application with a liberty to question the correctness of the order dated 24.02.2021 passed by the Sub-Divisional Officer-cum-Licensing Authority, Phulparas, whereby the petitioner's licence to run the PDS shop under Bihar Targeted Public Distribution System (Control) Order, 2016 {in short (Control) Order} has been

The application is disposed of with a liberty to the petitioner to prefer appeal against the said order dated 24.02.2021 which is sought to be challenged by filing an amendment petition through I.A. No. 1 of 2022. It is indicated that if an appeal is preferred within four weeks from today with an application seeking condonation of delay, the Appellate Authority shall keep in mind the fact that the petitioner was pursuing his remedy before this court by filing present writ application and decide the prayer for condonation of delay accordingly. It is further expected that the Appellate Authority shall be required to dispose of the appeal within the period stipulated under the (Control) Order.
