The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 307, 302, 120(B)/34 of the Indian Penal Code.

As per prosecution case, FIR named accused persons including the petitioner came at the door of the informant where co-accused Subhas Yadav had fired from his pistol which hit son of the informant due to which he succumbed to injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The entire allegation of

No.11079 of 2023(2) dt.04-05-2023 2/3 assaulting against the petitioner is general and omnibus in nature rather the specific overt-act of firing upon the son of informant is against co-accused namely, Subhas Yadav. The petitioner is alleged to be member of mob and falsely been made accused in the present case. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Moreover, similarly situated co-accused namely, Bhavesh Kumar has already been granted bail by a coordinate Bench of this Court vide order 23.12.2022 passed in Cr. Misc. No. 50522 of 2022 and in support of this Annexure2 has been annexed with this petition. It is further submitted that the petitioner is languishing in judicial custody since 31.2.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kishanpur P.S. Case No. 77 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
