JUSTICE SANJAY PRIYA ORAL ORDER 21-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Majhauliya P.S. Case 382 of 2016 instituted for the offence under Sections 366(A), 511 and 34 of the Indian Penal Code.
It is alleged in the written report that petitioner attempted to kidnap the minor daughter of the informant. The statement of the victim girl has been recorded under Section 164 Cr. P.C. wherein she has stated that petitioner attempted to kidnap her.
The counsel for the petitioner has annexed a copy of compromise petition (Annexure-3) filed before the court below which shows that compromise has taken place between the parties. Petitioner is said to be in custody since 29.12.2016.
Patna High Court Cr.Misc. No.13697 of 2017 (3) dt.21-04-2017 It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Majhauliya P.S. Case No. 382 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S,Ali/- U T
