Learned counsel for the petitioner submits that they had filed an application before the Circle Officer, Dehri, Rohtas for demarcation, but the same has not been annexed in the writ petition.
Without going into the dispute, it is directed that the petitioner will file a fresh application for demarcation before the Circle Officer concerned and the Circle Officer will thereafter act in accordance with law.
It is made clear that the suit was decreed in favour of the petitioner and the relief claimed does not require filing of any execution case by the plaintiff-petitioners whose father was the plaintiff in the Court below.
Under these circumstances, the application for demarcation, if filed within four weeks from today, the same shall be disposed of by the Circle Officer, Dehri, Rohtas within
Patna High Court CWJC No.18311 of 2018(2) dt.08-09-2022 2/2 eight weeks from today and consequential action i.e. measurement and demarcation must be done within the same period.
With the aforesaid observation and direction, this application is allowed.
