2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Barahiya P.S. Case No. 100 of 2022 registered for the offence punishable under Sections 406, 409 and 420/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 29.02.2024 passed in Cr. Misc. No. 78464 of 2023, which reads as under:

2. The petitioner seeks regular bail in connection with Barhiya P.S. Case No. 100 of 2022 dated 18.05.2022, lodged under Sections 406, 409, 420 and 34 of the I.P.C.

3. As per the prosecution case, the petitioner and the Branch Manager are said to have defalcated around Rs. 20 lakhs of the KCC loan. The entire amount was transferred in the account of the petitioner. The materials have come during investigation in support of the allegations. The loanees have said that the petitioner has withdrawn the entire money. It seems that the petitioner and the Branch Manager conspired to cheat the Bank.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 02.07.2023 having clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner in connivance with Bank Manager have committed the said crime.

6. Considering the nature of allegation levelled against the petitioner, I am not inclined to grant bail to him and therefore, his bail petition is hereby rejected.

7. The Trial Court is directed to expedite the trial as early as possible"

4. Learned counsel for the petitioner submits that the trial has started.

5. In view of the fact that huge defalcation has been made by the accused persons, I am not inclined to grant bail to the petitioner.

6. Accordingly, the application stands dismissed.

7. If the trial is delayed further by the prosecution, the petitioner may renew his prayer for bail.
